End User License Agreement (EULA)

1. License Grant — Software Is Licensed, Not Sold

The Dream Engine platform and all associated software, content, and services are licensed, not sold, to you. Dream Engine Kids LLC grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Software solely for personal, non-commercial, educational purposes, subject to the terms and conditions of this EULA.

This license does not convey any ownership interest in the Software. You acknowledge that the Software and all copies thereof are and shall remain the sole and exclusive property of Dream Engine Kids LLC.

This license is valid only for the duration of your active subscription or authorized access period and terminates immediately upon expiration, cancellation, or breach of this EULA.

2. Intellectual Property Ownership

The following are the exclusive proprietary assets of Dream Engine Kids LLC and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws:

• AI Models: All artificial intelligence models, machine learning algorithms, neural networks, and AI processing pipelines developed by or for Dream Engine Kids LLC, including but not limited to content generation models, safety filtering systems, and educational AI tools (collectively, the "Dream Engine AI Models").
• Source Code: All source code, object code, software libraries, APIs, backend infrastructure, database schemas, and related technical documentation comprising the Dream Engine platform.
• Educational Content: All curriculum materials, lesson plans, course structures, quiz content, learning progressions, educational frameworks, and instructional design created by Dream Engine Kids LLC.
• Branding: The "Dream Engine," "Dream Engine Kids," "Dreema," and all related names, logos, mascots, visual designs, user interface elements, and trade dress.
• Data & Training: All training data, datasets, model weights, fine-tuning outputs, and proprietary methodologies used in the development of the Dream Engine AI Models.

Nothing in this EULA transfers or assigns any intellectual property rights from Dream Engine Kids LLC to any user. All rights not expressly granted herein are reserved by Dream Engine Kids LLC.

3. User-Created Content

Users retain ownership of original content they create using the Software (e.g., AI-generated images, music, and videos created through user prompts). However, this ownership is subject to the following conditions:

• User-created content may only be used for personal, non-commercial, educational purposes unless otherwise agreed in writing.
• User-created content may not be used to train competing AI models or services.
• Dream Engine Kids LLC retains the right to use anonymized, aggregated usage data to improve the platform.
• Users grant Dream Engine Kids LLC a limited license to display, store, and process user-created content solely to operate and provide the service.

4. Restrictions — Prohibited Activities

You agree that you will NOT, under any circumstances:

• Reverse Engineer: Decompile, disassemble, reverse engineer, or otherwise attempt to derive the source code, algorithms, or underlying structure of the Software or the Dream Engine AI Models.
• Scrape or Extract: Use automated tools, scripts, bots, crawlers, or any data mining or extraction methods to scrape, copy, or harvest any data, content, AI model outputs, or other materials from the Software.
• Copy or Redistribute: Copy, reproduce, distribute, sublicense, sell, lease, rent, or otherwise transfer the Software or any portion thereof to any third party.
• Modify: Modify, adapt, translate, or create derivative works based on the Software without express written permission from Dream Engine Kids LLC.
• Circumvent Security: Attempt to bypass, disable, or circumvent any security, authentication, access control, content moderation, or digital rights management mechanisms.
• Competitive Use: Use the Software, its outputs, or any information obtained from the Software to develop, train, or improve any competing product or service.
• Generate Harmful Content: Use the AI tools to generate content that is violent, sexually explicit, hateful, discriminatory, harassing, illegal, or otherwise harmful or inappropriate, particularly given our audience of children ages 8–16.

5. Children's Use & COPPA Compliance

Dream Engine is designed for users ages 8–16. For users under the age of 13, verifiable parental consent is required before the child may access or use the Software. Parents and guardians are responsible for supervising their child's use of the platform. See our COPPA Compliance page and Privacy Policy for details.

6. Termination

This EULA is effective until terminated. Dream Engine Kids LLC may terminate this license at any time if you breach any term of this EULA. Upon termination:

• Your right to access and use the Software ceases immediately.
• You must destroy all copies of the Software in your possession.
• Sections 2 (Intellectual Property), 4 (Restrictions), 7 (Disclaimer), 8 (Limitation of Liability), and 10 (Governing Law) survive termination.

7. Disclaimer of Warranties

THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. DREAM ENGINE KIDS LLC DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. DREAM ENGINE KIDS LLC DOES NOT WARRANT THAT THE SOFTWARE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT AI-GENERATED CONTENT WILL BE ACCURATE, APPROPRIATE, OR FREE FROM DEFECTS.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL DREAM ENGINE KIDS LLC, ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SOFTWARE. DREAM ENGINE KIDS LLC'S TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID TO DREAM ENGINE KIDS LLC IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM OR ONE HUNDRED U.S. DOLLARS ($100.00), WHICHEVER IS GREATER.

9. Indemnification

You agree to defend, indemnify, and hold harmless Dream Engine Kids LLC and its affiliates from and against any and all claims, damages, liabilities, costs, and expenses (including reasonable attorney's fees) arising from: (a) your use of the Software; (b) your violation of this EULA; (c) your violation of any third-party rights; or (d) any content you create or transmit through the Software.

10. Governing Law & Dispute Resolution

This EULA shall be governed by and construed in accordance with the laws of the State of Georgia, United States, without regard to its conflict of law provisions.

Any disputes arising out of or relating to this EULA or the Software shall be resolved exclusively in the state and federal courts located in Cobb County, Georgia. You hereby consent to the personal jurisdiction and venue of such courts.

Before filing any legal claim, you agree to first contact Dream Engine Kids LLC at legal@dreamengine.ai and attempt to resolve the dispute informally for at least thirty (30) days.

11. Severability

If any provision of this EULA is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

12. Entire Agreement

This EULA, together with the Terms of Service, Privacy Policy, and COPPA Compliance Policy, constitutes the entire agreement between you and Dream Engine Kids LLC regarding your use of the Software and supersedes all prior agreements.
